TERMS OF USE FOR GUARDIANS

The terms of purchase for a guardian - skolelyst.no

1. In General


These purchase conditions apply to the guardian's order of TINE-products on  www.skolelyst.no, in connection with the subscription scheme for school milk, etc. for students in Norwegian primary school. 
The agreement between TINE SA and you consists of information about the products purchased on www.skolelyst.no, and any direct correspondence between the parties, as well as these terms and conditions. Consumer purchases on the internet are governed by additional regulations including the Consumer Purchase Act, the Cancellation Act, the Marketing Act, the Personal Data Act, the E-Commerce Act and the Credit Purchase Act. The terms of this Agreement will not be misconstrued as a limitation to these statutory rights, but they establish the parties main rights and obligations for the purchase.
Only persons over the age of 18 can order TINE products on www.skolelyst.no.


2. Definition of the parties


The seller is: TINE SA, Postboks 25, 0051 Oslo, org.no. 947 942 638 MVA, telephone: 513 71 510 and email skolelyst@tine.no (hereinafter the "TINE", "we" or "us").
The buyer is: the person who is entered as the buyer in the purchase order (hereinafter the "buyer," "you," "you" or "your").


3. Creation of a user account on skolelyst.no


To enrol your child for Skolelyst, you must have an e-mail address. 
The e-mail address that you provide will be used for sending out:
⦁ any reminders regarding the non-payment of the Skolelyst subscription.
⦁ reminders about the ordering of your subscription for the next school year.
⦁ necessary information from TINE Skolelyst. 
⦁ surveys in connection with, for example, quality assurance of www.skolelyst.no and the development of new products.
You agree and understand that you are going to hold the password to www.skolelyst.no in strict confidence. You are responsible for all the activities on your www.skolelyst.no account. If you become aware of improper use of your account or your password, please contact TINE Skolelyst immediately on the telephone number 513 71 510 or email to skolelyst@tine.no.


4. Ordering and subscription duration


The subscription for products provided by TINE is made for one school year at a time. When your order has been registered with us it is binding. When TINE has received your order, TINE will without undue delay send an order confirmation to you by e-mail. 
This agreement is exempt from cancellation according to the Cancellation Act § 22 letter b) because the products that TINE offers are perishable or quickly go out of date. 
The subscription is calculated to run from the start date of school in the school’s calender to the last day of school in its school year. It can take between 7 to 10 days from when we receive your purchase order to when the product is first delivered to the  school. The date of the first delivery of the product will serve as your order confirmation. 
When moving to another school, you must cancel the current order at www.skolelyst.no and order a new subscription at the new school. Alternatively, you can contact TINE Skolelyst on the phone number 513 71 510 or e-mail to skolelyst@tine.no no later than 14 days before starting at the new school. 
You can stop the subscription scheme for school milk at any time. The cancellation period is 14 days from the time it is received. The remaining amount you have for the 2017/2018 school year will be refunded.


5. Price and payment


The prices for the products are determined by TINE before each school year. All prices include sales tax (MOMs). The amount is calculated from the first day the product(s) are delivered to your child at school through to the end of the school year. The total cost for the subscription will appear before ordering.
The products cost the same at all schools in which the guardians order the subscription from at www.skolelyst.no. School milk specifically white milk is subsidised through support from the sales tax revenue for milk. 
As described on the website www.skolelyst.no when you order, you can choose between different payment methods.  
Late payments accrue interest and expenses in accordance with the law on interest rates, late payments and the debt collection law.


6. Product offering/range of products


Each school determines which products are available for order at www.skolelyst.no. TINE has no impact on which products a school offers, beyond that the school must offer at least three products, two of which must be milk. 
You can change the products and number of days in the course of your subscription period, as described on www.skolelyst.no.


7. Delivery


TINE is responsible for delivering the products to the school according to the agreed-upon delivery days of the school. The school is responsible for further distribution of the products to the students.


8. Delays and shortcomings


There is a delay if the products are not delivered on the school’s agreed-upon delivery days and if this is not due to: 
a) conditions beyond TINE’s control.
With a delay, TINE will repay the purchase price of the product, provided that the guardian sends their claim in accordance with clause 9 below. 
The product has a shortcoming if it is not in accordance with the information that TINE gave about the product. Should there be a shortcoming TINE will repay the purchase price of the product, provided that the parent sends their claim in accordance with clause 9 below.
The purchaser is not entitled to a refund of any invoice.


9. Complaints


The buyer must send a claim with the circumstances regarding non-delivery of the products that had been ordered to TINE within a reasonable time after the delivery date has passed.
If the buyer wants to claim a shortcoming to TINE, the buyer must notify TINE of this within a reasonable time after the shortcoming was discovered. The deadline for a complaint is within two months from the time you discovered the shortcoming. 
If you do not make a complaint about a return within this time frame then your right to do so is lost.  
All complaints about delays and shortcomings must be registered by the buyer with the electronic form available on www.skolelyst.no.


10. The registration and use of personal information


With this agreement, the buyer accepts that TINE can collect and store personal information about you and the child that receives products from TINE to the extent that is necessary for the administration and implementation of this agreement. This includes contact information such as name, phone number, e-mail address, school affiliation, and similar information. 
TINE automatically stores information when you visit our website, including your IP address, activity, date and time of the request. The purpose of this is to improve the service and to prevent fraud or abuse. This information will be removed when the customer relationship between you and TINE expires. Your credit card information is not stored on our servers. 
TINE stresses that all processing of your and the child's personal information takes place in accordance with the Personal Data Act.
